Пражская Квадриеннале (ПК) – это крупнейшее в мире выставочное мероприятие, посвященное изобразительному искусству. Координатором польской экспозиции ПК 2015 является Театральный институт им. Збигнева Рашевского, а организатором Министерство культуры и национального наследия.
Куратор польской Национальной Экспозиции – Агнешка Елевская (Agnieszka Jelewska). Выставка была создана группой художников и экспертов: Михалом Чихим (Michał Cichy), Павлом Яницким (Paweł Janicki), Михалом Кравчиком (Michał Krawczyk) и Рафалом Запалой (Rafał Zapała), а также архитектором и сценографом Ежи Гуравским (Jerzy Gurawski).
Польская работа Студенческой Экспозиция, авторства Малгожаты Вдовик (Małgorzata Wdowik), Тамары Антониевиц (Tamara Antonijevic) и Роберта Лесига (Robert Läßig), оказалась среди трех номинантов в категории наиболее перспективных талантов (вместе с чешской и латвийской экспозицией, награжденной золотой медалью).

Министр финансов произвел изменения в правилах подачи заявок о выдаче индивидуальных объяснений.
Заявки, касающиеся подоходного налога с юридических лиц, необходимо подавать Директору Казенной Палаты в Быдгоще, Катовицах, Познани или Варшаве (соответственно места жительства или резиденции заявителя).
В то время как, заявки в вопросах, касающихся подоходного налога с физических лиц и НДС, необходимо подавать Директору Казенной Палаты в Быдгоще, Лодзи, Катовицах, Познани и Варшаве (соответственно места жительства или резиденции заявителя).
В случаях, связанных с другими налогами, чем вышеупомянутый, заявки необходимо подавать Директору Казенной Палаты в Варшаве или Катовице.
Следует также отметить, что с 1 июля 2015 г. будет применяться новая модель применения для индивидуального интерпретация ORD-IN и приложение ORD-IN / А.

Банковский исполнительный лист (БИС) – это документ, в котором подтверждается существование банковской задолженности по отношению к человеку, которому, например, был предоставлен кредит, либо, который гарантировал погашение задолженности. В случае не выполнения договора другой стороной, банк выставляет БИС. Далее БИС требует судебного решения о приведении в исполнение, а также является основой для возбуждения исполнительного производства.
Тем не менее, 14 апреля 2015 г. Конституционный суд постановил, что ст. 96 п. 1 и ст. 97 п. 1 закона от 29 августа 1997 г. о Банковском праве несовместимы со ст. 32 п. 1 Конституции. Эти положения теряют силу 1 августа 2016 г. Таким образом, Конституционный суд поставил под сомнение конституционность этого инструмента.
Конституционный суд счел, что право выставлять БИС является прерогативой банков, которая нарушает принципа равного обращения (ст. 32 п. 1 Конституции), в трех аспектах. А именно, в отношениях между банком и его клиентом; в отношениях между банками как кредиторами и другими субъектами, которые являются кредиторами; а также в отношениях между должниками банков и должниками других субъектов.
Конституционный суд обратил внимание, что банки, помимо БИС, обладают широким набором инструментов обеспечения кредитов, а в частности векселем, который может стать основанием для выдачи ордера оплаты в соответствии со ст. 491 и ст. 492 гражданского процессуального кодекса.
Отсутствие возможности выдачи исполнительных листов предоставит должникам право на рассмотрение судом дела по существу.

The act on court fees in civil cases has been amended (Journal of Laws from 2010, No. 90, item. 594, as amended). The Act is intended to adapt the system to the ruling of the Constitutional Tribunal of 7 March 2013 (file SK 30/09). The Constitutional Tribunal stated the unconstitutionality of the current wording of Art. 79 paragraph 1 point 1 point f of the act on court fees in civil cases. The above mentioned article did not provide a refund of the fee of appeal against the decision, which is included for reasons other than obvious violation of the law. According to the Constitutional Tribunal, however, the fee should be refunded regardless of the nature of the infringement, which determined the need to repeal or amend the contested decision.
Today the court returns the fee only if the complaint against the decision of the court referendary was included because of a glaring infringement of the rights, which was confirmed by the court. The result of the amendment is following: if the parties submitted a complaint to the court referendary ruling was upheld, the court of its own motion reimburse the costs incurred in bringing the complaint. Also, when during the issuance of judgment there has been no glaring infringement of law.
On 18 of February 2014 the Council of Ministers adopted a resolution on recommendations in order to unify dates of entry into force of some normative acts concerning entrepreneurs. The aim of the resolution is introduction of the "two terms" principle, which means that the rules defining the conditions for the exercise of economic activity will come into force only two times a year: January 1 and June 1. Moreover, businesses will have at least 30 days to familiarize themselves with the rules before their date of entry into force. The government will also recommend to apply this principle to non-governmental bills. Such a recommendation would be in the position of the government to the project. This change will improve the functioning particularly micro, small and medium-sized businesses.
The Rule of Law and its general principles. The law on corporations’ and other collective entities criminal liability law in Poland is governed by the October 28, 2002 Act on the Liability of Collective Entities for Acts Prohibited Under Penalty (hereinafter referred to as “the Act” or “the Law”). The Act came into force on November 27, 2003 (Journal of Laws (Dziennik Ustaw) No 88, item 553, with subsequent amendments) and established the rules of enforcing criminal (crimes or fiscal crimes) liability on corporations’. The Act also sets out the principles of its operations and the penalties imposition code for such liability. When the Act came into force, it was quite an innovative change in the Polish legal system as it allowed imposing the liability on the offences committed by a specific person but also on collective entities. Its provisions were considered by the Polish Constitutional Tribunal (Judgment of the Constitutional Tribunal from the 3 of November 2004, 18/03) and amended in 2005 by the Parliament (amended by the Amending Act of 28 July 2005, Journal of Laws of 2005, No. 180, item. 1492) in accordance with a Tribunal decision. The criminal liability of an entity is secondary to the criminal liability of an individual acting on its behalf, and therefore prolonged criminal proceedings to establish the liability of an individual tend to discourage courts from considering the liability of corporate entities.(...)

In accordance with Art. 299 § 1 of the Polish Commercial Companies Code, the ineffectiveness of enforcement against the company leads to joint and several liability of board members of the company. Member of the board may be free from liability if he proves one of three conditions: - at the right time reported for bankruptcy or composition proceedings initiated, or - that the failure to report for bankruptcy and failure to initiate settlement proceedings was not his fault, or - that despite the failure to notify the bankruptcy petition or the settlement proceedings does not incumbered creditor rights (Art. 299 § 2 of the Polish Code of Commercial Companies) . Thus, if a member of the board fails to demonstrate any of the above conditions, it is responsible for the company liabilities.This applies in particular to the situation in which the chairman of the board files an application for bankruptcy and still is the manager of the company. If resignation of the chairman was ineffective, the execution will be carried out of the assets of the chairman. The Supreme Court in its judgment from 6 December 2013 ( I CSK 54/13 ) highlighted that a resignation of the position of the chairman is incredibile when one cannot read by whom it was signed (stamp and name on the document are illegible ). In that judgment , the Supreme Court dismissed an appeal by Zbigniew B., who claimed that he filed resignation from the chairman, due to the fact, that the evidences gathered in the case showed that documents of the company were issued with his signature.

For infringing collective consumer interests a penalty was imposed on PKO BP of over 29 million zł (the OCCP decision is not final). In the view of the Office for Competition and Consumer Protection a possibility of making arbitrary decisions by PKO BP to change the interest rates on consumer credit, just one day of taking effect of information form describing the terms of the loanargue for the imposition of penalties on the bank. The core issue was that in information the bank stipulated that the credit interest rate may change, but did not specify on what conditions this can take place. Such a formulation gave the bank the possibility of making arbitrary decisions. The OCCP concluded that such provisions are too vague and ambiguous - PKO BP has violated the information obligations. Before concluding a contract with a consument, each financial institution must provide the the information form containing data on the costs of the loan. The document should be valid for such time that the customer can easily compare different offers. Information forms of PKO BP were valid only for one day – such time does not allow to make a rational decision. More information: uokik.gov.pl
